Privacy policy

This Privacy Policy explains how we collect and use personal data when you visit sgcwines.com, join one of our waiting lists, attend one of our tastings or buy our wines, and the rights you have over your data.
1. Who we are
1.1 SGC Wine Estates wines are sold by two companies:
- Soil Origination International Limited, a company registered in Cyprus, which sells SGC La Liberté; and
- Les Vins Étoilés Sarl, Rue du Nant 22, 1207 Geneva, Switzerland, which sells SGC Gold.
1.2 Each company is the controller of the personal data of its own customers. For our website, waiting lists, tastings and marketing, the two companies decide together how personal data is used and act as joint controllers. You can exercise your rights against either of them by contacting us as set out in clause 1.3.

2. The personal data we collect
2.1 Information you give us: your name, email address, telephone number, postal address and company; your answers to our questions, for example your profile as a buyer, the wines you collect and how you heard about us; your orders; and the messages you send us by email, WhatsApp or telephone.
2.2 Information we receive when you buy: order and delivery details, and payment information. Card payments are processed by our payment providers; we never see or store your full card number.
2.3 Information collected automatically: when you visit our website, and with your consent where required, we collect information about your device and your use of the website, such as your IP address, browser type, the pages you view and how you arrived on our website. We do this using cookies and similar technologies (see clause 8).
2.4 Information from others: if a member of Le Cercle SGC, a partner or a company hosting one of our tastings introduces you to us, we may receive your name and contact details from them.
2.5 Our wines are sold only to adults. We do not knowingly collect personal data from anyone under 18.
3. Why we use your data and our legal bases
3.1 We use your personal data for the following purposes:

3.2 We do not sell your personal data. We do not make decisions about you based solely on automated processing that produce legal effects or similarly significant effects.
4. Who we share your data with
4.1 We share personal data only where necessary for the purposes described in clause 3, with:
- our group companies: Soil Origination International Limited, Les Vins Étoilés Sarl and SGC Support Services UK Ltd;
- service providers who process data on our behalf, including Shopify (online shop), Recharge (allocations and renewals), our payment providers, HubSpot (customer relationship management), Powerful Form Builder (website forms), Google (email, website analytics, advertising and YouTube), Meta (Facebook, Instagram and WhatsApp), LinkedIn, X (formerly Twitter), UpPromote (referral programme), Xero (accounting) and Workhorse (stock management and invoicing);
- carriers and logistics providers, to deliver your wine;
- professional advisers, such as accountants and lawyers;
- public authorities, where the law requires it.
4.2 Our service providers may use your data only on our instructions and must keep it secure. When we use advertising platforms (Google, Meta, LinkedIn and X), those platforms may also use the data for their own purposes, as independent controllers, under their own privacy policies.
5. International transfers
5.1 Our companies are based in Cyprus, Switzerland and the United Kingdom. Some of our service providers are based in, or access data from, other countries, including the United States, Canada and New Zealand.
5.2 When personal data is transferred outside the United Kingdom, the European Economic Area or Switzerland, we rely on an adequacy decision where one exists — including, for certified companies in the United States, the EU–US Data Privacy Framework and its UK and Swiss extensions — or on standard contractual clauses approved by the relevant authorities. You can ask us for more information about these safeguards.
6. How long we keep your data
6.1 Customers: we keep your data for as long as you are a customer and then for 6 years after your last purchase of SGC La Liberté, or 10 years after your last purchase of SGC Gold, to meet our accounting and tax obligations and to deal with any claims. After that, we delete or anonymise it.
6.2 Prospects (people who have joined a waiting list, contacted us or attended a tasting without buying): we keep your data for 3 years after your last interaction with us, for example opening or clicking one of our emails, replying to us or attending an event. After that, we delete it, unless you tell us that you wish to stay in touch.
6.3 Marketing preferences: if you withdraw your consent or unsubscribe, we keep a record of your request so that we do not contact you again.
6.4 Cookies: we keep your cookie choices for up to 13 months, after which we ask you again.
7. Your rights
7.1 You have the right to access your personal data, to have it corrected or deleted, to restrict or object to its use, and to receive it in a portable format. Where we rely on your consent, you may withdraw it at any time; this does not affect the lawfulness of the processing carried out before you withdrew it.
7.2 You have an absolute right to object to the use of your data for direct marketing. Every marketing email includes an unsubscribe link, and you can also write to us at any time.
7.3 To exercise your rights, write to clients@sgcwines.com. We will reply within one month. We may ask you to confirm your identity.
7.4 If you are not satisfied with how we handle your data, you can complain to a data protection authority, in particular the Information Commissioner's Office in the United Kingdom (ico.org.uk), the Commissioner for Personal Data Protection in Cyprus (dataprotection.gov.cy), the Commission Nationale de l'Informatique et des Libertés in France (cnil.fr) or the Federal Data Protection and Information Commissioner in Switzerland (edoeb.admin.ch). You may also contact the authority of the country where you live or work. We would, however, appreciate the chance to address your concerns first.
8. Cookies and similar technologies
8.1 Our website uses cookies and similar technologies, such as pixels:
- Essential cookies make the website and online shop work, for example your basket and checkout. They do not require your consent.
- Analytics cookies help us understand how visitors use our website (Google Analytics and HubSpot).
- Marketing cookies allow us and our advertising partners (Google, Meta, LinkedIn and X) to measure the effectiveness of our advertising and to show you relevant ads.
8.2 We use analytics and marketing cookies only if you accept them through our cookie banner. You can change your choices at any time through the Cookie settings link at the end of this policy, or by deleting cookies in your browser.
9. Security
9.1 We take appropriate technical and organisational measures to protect your personal data against loss, misuse and unauthorised access. Access to your data is limited to the people who need it for their work.
10. Changes to this Privacy Policy
10.1 We may update this Privacy Policy from time to time. The latest version is always available on our website, with the date of its last update. If we make significant changes, we will tell you by email or on our website.
